Terms of Use

These Terms of Use (the “Terms”) govern your use of the Swipe Photos Cleanup mobile application (the “App”) provided by HO CHIU FUNG (“we”, “us”, or the “Service Provider”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on a device that you own or control, in accordance with the Apple Media Services Terms and Conditions.

2. Subscriptions and In-App Purchases

The App offers the following premium products:

Auto-renewal terms (Premium Monthly):

Refunds. Purchases are processed by Apple. Refund requests are handled by Apple in accordance with Apple’s policies. Visit reportaproblem.apple.com to request a refund.

3. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose; (b) reverse engineer, decompile, or disassemble the App; (c) interfere with or disrupt the App; or (d) use the App to violate the rights of any third party.

4. User Content and Photos

The App reads photos and videos from your device’s photo library so you can sort, mark for deletion, and clean up your library. All processing happens on your device. We do not upload, store, or transmit your photos or videos to any server. See the Privacy Policy for full details.

You are solely responsible for the content of your photo library and for any deletion decisions you make using the App. We strongly recommend keeping a current backup (e.g., iCloud Photos) before performing bulk cleanup.

5. Disclaimers

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of Liability

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, whether incurred directly or indirectly, arising from your use of or inability to use the App. Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid for the App or in-app purchases in the twelve (12) months preceding the claim.

7. Changes to the App and Terms

We may modify, suspend, or discontinue the App at any time. We may also update these Terms from time to time by posting the revised version. Your continued use of the App after changes constitutes acceptance of the revised Terms.

8. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App if you violate these Terms.

9. Apple as Third-Party Beneficiary

You acknowledge that these Terms are between you and the Service Provider, and not with Apple. Apple is not responsible for the App or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. Any maintenance, support, warranty, product liability, intellectual-property, and end-user obligations shall be governed by the Apple Media Services Terms and Conditions and the applicable provisions of the Apple Developer Program License Agreement, in addition to these Terms.

10. Governing Law

These Terms shall be governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws provisions. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
